Terms of Service

AJAI Engage provides AI-assisted website and social conversation workflows, including conversation monitoring, response drafting, operator alerts, lead capture, and related customer support tools. The exact features available may depend on a customer's plan, configuration, and connected third-party services.

The service is provided on an as-is and as-available basis. AJAI works to provide a reliable product, but we do not guarantee that the service will be uninterrupted, error-free, secure, or available at all times.

Users and customers are responsible for using AJAI lawfully and for ensuring that their use of Engage, Meta, Messenger, social channels, websites, and customer data complies with applicable laws, platform rules, privacy obligations, and industry requirements.

Users may not use AJAI to:

• Send spam, deceptive messages, harassment, or abusive communications.
• Violate laws, regulations, platform policies, or third-party rights.
• Collect, process, or disclose personal data without required rights or consent.
• Upload malware, attempt unauthorized access, or interfere with service security.
• Misrepresent AI-generated output as human communication where disclosure is required.
• Use the service for illegal, harmful, fraudulent, or high-risk activities.

AJAI may suspend or limit access to the service if we believe usage is abusive, unlawful, harmful, creates security risk, violates these Terms, or could damage AJAI, customers, users, third-party platforms, or the public.

AJAI and its licensors retain all rights in the AJAI platform, software, designs, workflows, documentation, trademarks, and related technology. Customers retain rights to their own content, customer data, brand assets, and materials, while granting AJAI the limited rights needed to provide, secure, support, and improve the service.

AJAI may interoperate with third-party services such as Meta, OpenAI, Stripe, Supabase, analytics providers, and other customer-authorized integrations. AJAI is not responsible for third-party services, their availability, or their independent terms and policies.

AJAI provides the messaging platform through which businesses using AJAI may communicate with their customers via SMS. Messages may include appointment reminders, booking updates, project updates, customer support, quote follow-ups, review requests, and promotional messages where separately permitted. Recipients must provide prior consent before receiving SMS messages.

Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for assistance. Opting out of SMS does not prevent non-SMS communications that are otherwise permitted. Consent to receive SMS messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

Customers using AJAI are responsible for collecting valid consent, honoring opt-outs, accurately identifying their business in messages, and complying with TCPA, CTIA, carrier, Twilio, and other applicable requirements. AJAI may suspend messaging access for spam, purchased lists, deceptive opt-in practices, ignored opt-outs, or other noncompliant use.

To the maximum extent permitted by law, AJAI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising from or related to the service.

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles. Except where applicable law requires otherwise, any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Baldwin County, Alabama, and each party consents to the personal jurisdiction and venue of those courts.
